6. Exclusion of Liability for Technical Support
Zenith Bank shall not be in default of any obligation if performance is hindered by events beyond its control including without limitation, internet failure, computer equipment failure or telecommunications failure. Zenith Bank shall also not be liable for any damage that may result to the user’s technical equipment, particularly computers, software, network equipment or any other equipment used to access or use the service and/or the information.

To the extent permitted by law, Zenith Bank shall not be held liable to the User for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defense or settlement costs) whatsoever arising out of or referable to Material on the Zenith Bank website whether in contract, tort including negligence, statute or otherwise.
Under no circumstances will Zenith Bank be liable for any direct or indirect, special, incidental or consequential losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defense or settlement costs) whatsoever arising out of or referable to material or information or in connection with any failure of performance, error, omission, interruption , defect, delay in operation or transmission, computer virus or system failure on the Zenith Bank website.
8. Security
For the purpose of Internet Banking a User is required to be a customer of the Bank. The User will be required to provide accurate and up to date information for the registration of this service. Upon registration the user will be given an Access Code and Username and will be required to choose a Password. The password chosen by the User should be simple and unique.
The User should under no circumstances disclose his/her Access code/ password to a third party or write the Access code or password in an open place in order to avoid a third party from accessing same. The User shall log out from the website after its session is over. In the event that a User’s password or Access code is subject to unauthorized access he/she should immediately inform Zenith Bank.
All Users are advised to secure their Internet banking passwords and ATM pins with utmost confidentiality as the bank will not be liable for any loss arising from third party access to such information.
9. Submissions
All information submitted to Zenith Bank via this Website will be deemed and remain the property of Zenith Bank and Zenith Bank will be free to use, for any purpose, any idea, concepts, know-how or techniques contained in information a User of this Website provides Zenith Bank through this Website. Zenith Bank will not be subject to any obligations of confidentiality regarding submitted information except as otherwise specifically agreed or required by law.
10. Indemnification
Except when caused by Zenith Bank’s intentional misconduct or gross negligence, the User agrees to protect and fully compensate Zenith Bank and its affiliates and service providers from any/and all third party claims, liability, damages, expenses and costs (including, but not limited to, legal fees) caused by or arising from customer’s use of the service, violation of the terms or infringement, or infringement by any other user of User’s account, of any intellectual property or other right of anyone.
11. Service changes and discontinuation
Zenith Bank reserves the right to change or discontinue, temporarily or permanently, the service at any time without notice. In order to maintain the security and integrity of the service the bank may also suspend customer’s access to the service at any time without notice. The User agrees that the bank will not be liable to him/her or any third party for any modification or discontinuation of the service.
12. Additional Terms
Zenith Bank shall not be considered an agent or other legal representative of the User for any purpose by reason of this agreement and/or any other party whom the User is using this service to pay. This agreement cannot be changed by the User nor any of Zenith Banks rights waived unless the Zenith Bank agrees in writing or the User continues using the service following receipt of notice of any changes proposed by of Zenith Bank . This agreement is personal to the customer and the customer may not assign it to anyone.
13. Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the Republic of Ghana. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of the Republic of Ghana.
14. Acceptance
This agreement has been read and understood by me. I certify that I am an adult and hereby accept the terms and conditions of use of the Zenith Bank website.
